West Virginia
Cannabis Packaging Requirements
West Virginia cannabis packaging is regulated by the West Virginia Office of Medical Cannabis, Bureau for Public Health. The market is medical only. Packaging must be child-resistant, must carries no state universal symbol, and must print 3 required warning statements. Artwork must be approved by the state before printing. Royal Supply last reviewed this guide against the regulation on September 1, 2026.
Universal Symbol Requirements
Symbol Specifications
- No numeric type size is prescribed anywhere on the label.
- Label text must be easily readable and conspicuously placed.
Notes on this section — 1
- No point-size floor appears in the packaging and labeling rules; readability is judged at Bureau review.
- Do not fill the space with a substitute mark.
- Seals, flags, crests and coats of arms are prohibited — they imply government endorsement.
- What you do obtain: the Bureau's prior written approval of all packaging and label content, before printing.
- Office of Medical Cannabis, Bureau for Public Health — omc.wv.gov.
West Virginia has never required a cannabis symbol.
- The state publishes no symbol artwork.
- Potency goes on in words: species, THC percentage, CBD percentage, dose count.
- Every label still needs the Bureau's written approval before printing.

Packaging & Labeling Rules
- Child-resistant.
- Tamper-proof or tamper-evident — either satisfies the rule.
- Light-resistant and opaque.
- Resealable.
- Constructed to minimize oxygen exposure.
- Sealed at the grower/processor before it ships.
- Only an approved testing lab, the Bureau during an adverse-loss investigation, or the purchasing dispensary may break that seal.
- Label stock: easily readable, weather-resistant, tamper-resistant, conspicuously placed on the package.
- Grower/processor name, address and permit number.
- Form of the medical cannabis, plus quantity and weight.
- Number of individual doses in the package.
- Species, percentage of THC, percentage of CBD.
- Unique harvest batch or process lot identifier.
- Packaging date.
- Employee ID number of the packager — and of the shipper where that is a different person.
- Destination dispensary name and address.
- Expiration or use-by date.
- Storage instructions.
- All three mandated warnings (see the warnings list).
- At dispensary level, add the patient/caregiver receipt information and the safety insert.
- The Bureau may require other information beyond this list — ask before you lock the panel.
- Prohibited: any resemblance to the trademarked, characteristic or product-specialized packaging of a commercially available food or beverage product.
- Prohibited: any statement, artwork or design implying the package holds something other than medical cannabis.
- Prohibited: any seal, flag, crest, coat of arms or other insignia — anything implying government endorsement.
- Prohibited: any cartoon, COLOUR SCHEME, image, graphic or feature that might make the package attractive to children.
- That colour-scheme clause is the one designers miss. A palette alone can fail the rule with no image on the pack at all.
Notes on this section — 2
- Prior written approval covers all packaging and label content, so treat approval time as part of the print schedule, not a formality after it.
- The grower/processor label items are numbered subdivisions, 16.4.1 through 16.4.16 — not lettered. Cite them that way or a reviewer cannot find them.
- No universal symbol, THC diamond or state mark on any package.
- Reserve no space for one.
- Potency goes on in words: species, percentage of THC, percentage of CBD, number of individual doses.
- Do not invent a badge to fill the gap — seals, crests and coats of arms are prohibited.
Notes on this section — 1
- The absence was confirmed against the full section lists of the packaging and labeling rules; the state publishes no symbol artwork at all.
- Print verbatim: the medicinal-use, pregnancy and breastfeeding, driving and heavy machinery, keep-out-of-reach statement.
- Do not shorten or paraphrase that statement — edits to fixed text fail label review.
- In your own words: keep the product in the original container it was dispensed in.
- In your own words: unauthorized use is unlawful and carries criminal penalties.
- All three go to the Bureau with the label for prior written approval.
Notes on this section — 2
- No wording is prescribed for the two own-words warnings, so the Bureau's written approval is the only confirmation your phrasing passes.
- No point-size minimum is set for warning text; readability is judged at Bureau review.
- Required: the number of individual doses in the package.
- Show it alongside species, percentage of THC and percentage of CBD.
- Light-resistant and opaque.
- Constructed to minimize oxygen exposure.
- Applies to the sealed package as dispensed — no clear window, no translucent film.
- Packaging must be resealable.
- Sealed at the grower/processor before it ships.
- Only an approved testing lab, the Bureau during an adverse-loss investigation, or the purchasing dispensary may break the original seal.
- Prior written approval from the Bureau covers all packaging and label content. Budget review time.
- No cannabis symbol exists. Reserve no space, and invent no mark.
- Medical-only market — no adult-use rule set applies.
- Two rule sets apply at once: grower/processor packaging and labeling, and dispensary labels and safety inserts. A West Virginia product carries both.
- Prohibited: anything implying the package holds something other than medical cannabis.
- Prohibited: seals, flags, crests, coats of arms and similar insignia.
- Prohibited: cartoons, colour schemes, images, graphics or features attractive to children, and food or beverage lookalikes.
- Amendments to both 64-110 and 64-112 are in the legislative rule pipeline — the Secretary of State lists an In Progress version of each alongside the active 5/8/2025 filing, and a modification of the proposed 64-110 was filed on August 26, 2026. Neither touches a label. The proposed 64-112, agency-approved July 29, 2026 and before the LRMRC on August 12, 2026, was read line by line against the active filing this cycle: section 8 is carried forward word for word, and the only changes anywhere in the rule are a renumbering of the definitions and a sunset extension from August 1, 2030 to August 1, 2032. Section 16 of the proposed 64-110 is likewise carried forward unchanged.
Notes on this section — 2
- The rules in force are the 5/8/2025 filings of 64-110 and 64-112, and both remain the active versions.
- Because approval is artwork-specific, assume a later edit re-enters review rather than riding on the earlier sign-off; confirm with the Bureau if the change is trivial.
