North Dakota
Cannabis Packaging Requirements
North Dakota cannabis packaging is regulated by the North Dakota Dept. of Health and Human Services (NDHHS), Division of Medical Marijuana. The market is medical only. Packaging must be child-resistant, must carry the state universal symbol, and must print 6 required warning statements. Artwork must be approved by the state before printing. Royal Supply last reviewed this guide against the regulation on September 1, 2026.
Universal Symbol Requirements
Symbol Specifications
- Label text: 8 point minimum, Arial or Calibri.
- Small container: 6 point, or a peel-back or accordion label.
- Edibles: black Arial.
- Symbol minimum size is not in the labeling section. Ask NDHHS for the artwork spec.
- Use the Department-issued file as supplied.
- Surrounding packaging stays plain and opaque.
- Any color spec lives with the DHHS image, not in code. Confirm before print.
- Universal symbol: flower, concentrate and medical cannabinoid product containers.
- Pediatric symbol: concentrate and medical cannabinoid products only, if applicable.
- Never put the pediatric symbol on flower.
- Edibles: the rule allows these two symbols and the facility logo on the packaging, but statute bars an image other than text on edible labeling - resolve it with NDHHS at approval.
- Request current symbol files from the program.
- Program site: hhs.nd.gov/mm.
- Edible packaging and labeling need Department approval before use.
Notes on this section — 1
- No public download link is codified - the files are program-issued.
Two Department-issued marks, not licensee artwork.
- Universal symbol: identifies the container as medical marijuana.
- Pediatric symbol: signals the product meets the 6 percent pediatric THC cap.

Packaging & Labeling Rules
- Child-resistant required on all cannabis packaging.
- Plain, opaque and tamper-evident construction.
- Design must minimize appeal to minors.
- No resemblance to any commercially available product.
- Edible packaging: child-resistant, resealable and not transparent, by statute.
- Department packaging approval is the gate - submit before production.
- Edible packaging and labeling need approval before use.
- Confirm your closure and certification route with NDHHS before tooling.
Notes on this section — 1
- The rule names no CR test standard - there is no 16 CFR 1700 cite. CR performance is demonstrated through Department packaging approval instead.
- Type: 8 point minimum, Arial or Calibri.
- Small container: drop required information to 6 point, OR use a peel-back or accordion label that is easily identified as carrying it. Both options are available.
- Net weight in United States customary OR metric units - either alone is enough.
- Concentrate and product containers: net weight OR volume, in either unit system.
- Manufacturer business or trade name and registry certification number.
- Container identification number.
- Batch or process lot number.
- Date of harvest (flower) or date made (concentrate and product).
- Strain name or product identity.
- Expiration date.
- Total THC and total CBD concentration, as text.
- Universal symbol on every container.
- Pediatric symbol on concentrate and medical cannabinoid product labels if applicable - never on flower.
- The four consumer warnings, verbatim.
- Concentrates and products: disclose the extraction process and any solvents used.
- Medical cannabinoid products: ingredient list in descending order of predominance.
- Serving size and servings per container where applicable.
- Edibles: black Arial font only.
- Edibles: product name, manufacturer information, ingredient list, mg THC per serving, servings per package.
- Edible labeling: statute says it may not include an image other than text — see the note below before placing a symbol on one.
- Strain or brand names may not contain words referring to products commonly associated with or marketed to minors, and may not be false or misleading.
- The word 'organic' may not appear on a usable marijuana label.
- Leave space for the dispensary label: patient name, registry ID card number, dispensary name, date dispensed.
- Labels affixed by a compassion center must stay on the packaging.
Notes on this section — 6
- Our old page said net weight in U.S. and metric units. The rule says or. Corrected - do not force dual units onto a small panel.
- The 8 point floor reaches every label element this section requires, not a subset. Reading it narrowly is the direction that causes non-compliance.
- The edible art rule (black Arial, text only) sits in statute and runs alongside the 8 point Arial-or-Calibri rule. Arial satisfies both.
- Statute and rule do not line up on edible imagery. NDCC 19-24.1-24.1(3)(b) says edible LABELING may not include an image other than text; NDAC 33-44-01-24.2(3) permits the universal symbol, the pediatric symbol and the manufacturing facility logo on edible PACKAGING. Because edible packaging and labeling both need the Department's prior approval anyway, settle the question with NDHHS at approval rather than assuming either reading.
- The strain-name boundary: 33-44-01-23(2)(a)(3) keeps plant strain names out of a licensee's business name and logo, and 33-44-01-24 restricts the strain or brand name itself. Neither displaces 33-44-01-26(1)(a)(5), which requires the name of the strain as a label field.
- Dispensary-stage additions are applied by the dispensary, not by you - but the panel has to accommodate them.
- Universal symbol: required on flower, concentrate and medical cannabinoid product containers. No conditions.
- Pediatric symbol: Department-established image showing the product meets the 6 percent pediatric THC cap.
- Pediatric symbol applies to concentrate and medical cannabinoid product labels only, and only 'if applicable'.
- Never place the pediatric symbol on a dried leaves and flowers label.
- Print total THC and total CBD concentration as text as well as the symbol.
- Medical cannabinoid products: state THC and CBD per serving and per container.
- Edibles: mg THC per serving and servings per package.
- Request the current symbol files from NDHHS before a plate is cut.
Notes on this section — 2
- Artwork specs for both symbols - file, minimum dimensions, colors - are not in the labeling section and were not verified for this entry.
- If the specs rest on a DHHS-published image or template rather than codified rule, treat them as agency guidance, not a mandate.
- All four apply to every product type - flower, concentrate and medical cannabinoid product alike.
- Print verbatim. Do not merge, reword or abbreviate.
- Spell out Food and Drug Administration. Never FDA.
- Each statement keeps its terminal period.
- 8 point minimum, Arial or Calibri, like the rest of the label.
- No pregnancy, breastfeeding, impairment or delayed-onset warning is required in North Dakota.
- Dispensaries add no warning language - only patient name, registry ID, dispensary name and date dispensed.
Notes on this section — 3
- Our old page printed one merged composite that paraphrased three of the four statements. Replaced with the state's exact wording.
- The '5 mg / 50 mg, delayed by 2 or more hours' line we used to show was never a North Dakota warning. Those are formulation caps for edible lozenges, and delayed onset is handled by the activation-time field.
- The labeling section survived the 2025 edibles rulemaking unamended - its history note still ends July 1, 2022 - so no edible-specific warning was added.
- Any cannabinoid edible product package: 50 mg THC maximum, by statute.
- Edible lozenge: 5 mg THC per serving.
- Cannabinoid capsule: 50 mg THC per serving.
- Transdermal patch: 50 mg THC per serving.
- Topical: 6 percent THC maximum concentration.
- Pediatric medical marijuana: 6 percent THC maximum.
- Label serving size and servings per container where applicable.
- Concentrate containers may state an amount suggested for use at any one time instead of servings per container.
- Medical cannabinoid products: state THC and CBD per serving and per container.
- Activation time is its own required field on every container type, separate from serving size.
Notes on this section — 3
- These caps are formulation limits, not label copy. Do not print them as a warning statement.
- The 50 mg package ceiling is not lozenge-specific. NDCC 19-24.1-24.1(3)(a) sets it for the packaging of any cannabinoid edible product. The 5 mg per-serving figure is the one that comes from the lozenge definition.
- Applying the 5 mg per-serving figure to capsules, patches or topicals designs a panel against a limit the state never set for them.
- Opaque required on all cannabis packaging.
- Plain design, no window, no clear panel.
- Edible packaging must not be transparent, by statute.
- Multi-use packaging: resealable required.
- Edible packaging: resealable in every case, single-serving included.
- Edibles: hard or soft lozenges, square shape only.
- Any cannabinoid edible product package: 50 mg THC maximum, and the packaging must be resealable, child-resistant and not transparent.
- Each edible piece marked, stamped or imprinted with 'THC' or another Department-approved marking.
- Edibles may not be coated with sugar, candy or a flavor-enhancing ingredient.
- A nonflavored wax or oil coating on an edible needs written Department approval.
- Concentrate container for dispensing: 1 gram maximum.
- Cannabinoid solution container for dispensing: 30 mL maximum.
- No images of marijuana or marijuana paraphernalia.
- No colloquial or slang references to marijuana.
- No marijuana plant strain names in a licensee name or logo.
- No medical symbols bearing a reasonable resemblance to established medical associations.
- Edible packaging: no depiction of the product, no cartoons, no image at all other than the universal symbol, pediatric symbol or manufacturing facility logo.
- Medical only - the 2024 adult-use ballot measure failed, so no adult-use labeling regime applies.
- The edibles regime is new: statute effective August 1, 2025, rule effective October 1, 2025. Check for later NDHHS guidance before a first edible run - any such material is guidance, not codified rule.
- The Department has not published which alternative markings it accepts in place of 'THC'. Confirm any substitute with NDHHS rather than inferring one.
- Statute bars an image other than text on edible labeling while the rule allows two symbols and the facility logo on edible packaging. Put the question to NDHHS with the artwork, since edible packaging and labeling need its approval in any case.

- Cite the codified chapter at ndlegis.gov by section, not the program landing page - a label reviewer cannot verify a requirement from hhs.nd.gov/mm alone.
