All products — principal display panel1
Print the block whole and word for word, in bold, on the principal display panel. It is expressly carried onto the reduced label for edibles with insufficient container space under 16.8.3.9.M(5).
Every cannabis finished product, edibles sentence included — the rule carries no product-type limitation. Not required only where the labeling surface area is less than two inches squared, where the short-form warning replaces it.
Exact text required

New Mexico Regulation and Licensing Department (RLD), Cannabis Control Division prescribes this wording. Reproduce it character for character, including capitalization and punctuation.

For use only by adults 21 and older. Keep out of reach of children. Do not drive a motor vehicle or operate machinery while under the influence of cannabis. BE CAUTIOUS. Cannabinoid edibles can take up to two hours or more to take effect.
All products — information panel or static QR code1
On both small-package paths (16.8.3.9.M and .N) this is not among the elements that must stay on the face, but it must still be delivered by the QR code or a peel-back/accordion label. It is never omitted, only relocated.
Every cannabis finished product. It sits on the information panel, or in the content a static QR code reaches.
Exact text required

New Mexico Regulation and Licensing Department (RLD), Cannabis Control Division prescribes this wording. Reproduce it character for character, including capitalization and punctuation.

This product is not approved by the FDA to treat, cure, or prevent any disease. FDA has not evaluated this product for safety, effectiveness, and quality. There may be long term adverse health effects from consumption of cannabis, including additional risks for women who are or may become pregnant or are breastfeeding.
Small packages — under two square inches1
Trigger is package geometry alone. A labeled face of two square inches or more must carry the full 16.8.3.9.K(7) block instead. The balance of the required content moves behind a static QR code or a peel-back/accordion label under 16.8.3.9.N(7).
Labeled surface area of less than two inches squared. Available to any product type — this is the vape cartridge and small-container path.
Exact text required

New Mexico Regulation and Licensing Department (RLD), Cannabis Control Division prescribes this wording. Reproduce it character for character, including capitalization and punctuation.

For use only by adults 21 and older. Keep out of reach of children.
Seeds and immature plants1
Same sentence as the small-surface short form, but required here by product type rather than by package size, and required in bold.
Cannabis seeds and immature plants.
Exact text required

New Mexico Regulation and Licensing Department (RLD), Cannabis Control Division prescribes this wording. Reproduce it character for character, including capitalization and punctuation.

For use only by adults 21 and older. Keep out of reach of children.
All products — information panel or static QR code1
The rule requires the phone number as a data field and prescribes no sentence to carry it. This is Royal Supply implementation copy that satisfies the requirement in full — you may reword it. The rule does not print the number: obtain the current one from the Cannabis Control Division and confirm it before it goes on a print plate. Do not take it from a third-party summary.
Every cannabis finished product, on the information panel or in the content the static QR code reaches.
Required content — your wording

New Mexico Regulation and Licensing Department (RLD), Cannabis Control Division requires this information but does not fix the sentence. Write your own copy; the agency approves it.

In case of emergency, contact the New Mexico Poison and Drug Information Center: [phone number required on label].
Perishable edibles and topicals1
The rule mandates the statement, not any particular phrasing. Do not treat any specific sentence as fixed text.
Edible or topical products that are perishable or that meet the definition of a time/temperature control for safety food.
Required content — your wording

New Mexico Regulation and Licensing Department (RLD), Cannabis Control Division requires this information but does not fix the sentence. Write your own copy; the agency approves it.

State on the principal display panel that the product must be refrigerated.

Packaging & Labeling Rules

Child-ResistantContainers are child-resistant by default, with one express exception: products containing only cannabis flower need a resealable container and no child-resistant closure at all.
  • Child-resistant closure on every cannabis finished product container, unless otherwise provided.
  • Flower-only finished products: resealable container required, child-resistant container NOT required.
  • Multi-serving or multi-use containers must be resealable AND continually child-resistant.
  • The flower exception turns on contents, not on serving count — a multi-serving flower jar still takes the exception.
Notes on this section — 3
  • Resolved this cycle. The page previously carried this as an open question and told buyers not to design flower to a resealable-only spec; the codified paragraph grants the exemption in terms, so a resealable-only flower container is compliant and the child-resistant closure was being over-specified.
  • The exemption is written for products that contain ONLY cannabis flower. An infused pre-roll or a flower-plus-concentrate product falls back to the default.
  • The 16 C.F.R. 1700.15 / 1700.20 test-certificate duty is filed under Notable, and it reaches edible and topical containers only.
16.8.3.12.A(3) and A(4) NMAC
LabelingNew Mexico assigns every required element to a named panel, so lay the label out panel by panel rather than as one list.
  • Font: 1/16 inch minimum, measured on the height of a lower-case o.
  • English required. Other languages may be added.
  • Label must be unobstructed and conspicuous.
  • Label goes on the container.
  • Edibles and topicals only: also label any outer package used to display the product at retail.
  • No outer-carton label for non-edible, non-topical products such as vape hardware or flower.
  • Identify the intended use and directions for use.
  • More than one intended use: label for every use, and follow the most restrictive requirement where they conflict.
  • PDP: product identity or common name, bold, sized against the most prominent printed matter, parallel to the base as displayed.
  • PDP: net quantity, weight or volume, bold, in both U.S. customary and metric units.
  • PDP: put that quantity in the bottom 30 percent of the panel, in lines parallel to the base.
  • PDP: fluid measure for liquids, weight for solid, semi-solid or viscous products.
  • PDP: potency in bold, as confirmed by a cannabis testing laboratory.
  • PDP potency, edibles: Total THC and CBD in milligrams per serving.
  • PDP potency, all products: percent Total THC per container, plus percent CBD per container if detected.
  • PDP: the division-provided cannabis logo.
  • PDP: a second division logo for microbusiness and community-designated licensees.
  • PDP: refrigeration statement on perishable or time/temperature-control-for-safety edibles and topicals.
  • PDP: the required warning statement, in bold.
  • Information panel, or a static QR code that links the consumer to it, carries the rest — with no intervening material.
  • Info: manufacturer business or trade name, and manufacturer license number.
  • Info: qualifying phrase where the name shown is not the actual manufacturer. Manufactured for and distributed by are examples, not mandated wording.
  • Info: pesticide used in the product by the producer.
  • Info: solvents, processing aids and chemicals used in manufacture.
  • Info: date of manufacture.
  • Info: expiration date. It may not be altered, and no later date may be relabeled over it.
  • Info: ingredient list in descending order of predominance by weight or volume, using common or usual names.
  • Info: sub-ingredients in parentheses after any multi-component ingredient.
  • Info: name the cannabis extract or concentrate and each isolated cannabinoid as ingredients.
  • Info: pharmacologically active ingredients, if used.
  • Info: contains allergen statement at the end of or adjacent to the ingredient list, or the allergen in parentheses inside it.
  • Info: nutritional information meeting 21 CFR 101.9.
  • Info: the FDA disclaimer.
  • Info: New Mexico poison and drug information center phone number.
  • Info: state track and trace identifier.
  • Potency on an edible or topical label may not deviate more than 15 percent from the stated value.
  • Under 1 mg per serving may print as <1 mg. Optional — but if you use it, the container must also state Total THC or CBD for the whole container.
  • Small-package path M, edibles only, when container size leaves insufficient space.
  • Path M face: net weight or volume, product identity, division logo(s), manufacturer name, license number, potency, the full warning, track and trace ID.
  • Small-package path N, any product type, triggered solely by a labeled surface under 2 square inches.
  • Path N face: product identity, division logo at 1/2 by 1/2 inch minimum, manufacturer name, license number, potency, short-form warning, track and trace ID.
  • On both paths, everything else is delivered by static QR code or a peel-back/accordion label.
  • No reduced path exists for a non-edible with 2 square inches or more of labeled surface. It carries the full PDP and information panel.
  • Prohibited on the label: untruthful or misleading statements, including health or benefit claims.
  • Prohibited on the label: advertising or marketing.
  • Prohibited on the label: words associated with or marketed to minors, candy and candies included, unless the word names the cannabis strain.
Before you print
  • The rule does not print the poison center number. Get the current one from the division and confirm it before a plate is cut. Not from a third-party summary.
  • Subsection G: the container-total sentence that must accompany a <1 mg per-serving expression was confirmed on a targeted retrieval, but an earlier rendering of the same page returned only the first sentence. Confirm G against the printed NMAC PDF before publishing a low-dose potency layout.
Notes on this section — 3
  • In force is the 04/01/2022 filing. No post-2022 filing appears in the part.
  • CCD noticed amendments with hearings dated May 9 and September 3, 2025. Adoption could not be confirmed from a state source, so none of it is reflected above.
  • 2024 SB 6's downstream effect on this section has not been traced. 2024 HB 64 could not be confirmed as enacted, so no HB 64 language is carried.
16.8.3.9 NMAC (general rules at Subsections A–J; principal display panel at K; information panel or static QR at L; reduced label sets at M and N)
THC SymbolOne division-issued cannabis logo, half an inch square, on the principal display panel.
  • 0.5 by 0.5 inch minimum on the principal display panel of every cannabis finished product.
  • 0.5 by 0.5 inch minimum on each single serving of a multi-serving solid edible.
  • Principal display panel of seed and immature-plant packages.
  • Same 0.5 inch minimum on the reduced face of packages under 2 square inches.
  • Microbusiness and community-designated licensees add a second, separate division logo.
  • Use the division's supplied artwork. Do not recreate or redraw the mark.
Before you print
  • No rule names a source for the files. Request current artwork from the Cannabis Control Division.
Notes on this section — 1
  • Only the minimum dimension is set by rule. No rule prescribes the logo's colors.

Health WarningsThree statements across two panels, and New Mexico fixes the wording of only two of them.
  • PDP warning block: verbatim, bold, on every cannabis finished product.
  • Print that block whole. Its lead-in carries no product-type limit, so the edibles sentence prints on non-edibles too.
  • FDA disclaimer: verbatim, on the information panel or in the content a static QR code reaches.
  • On small packages the disclaimer moves behind the QR or peel-back label. Relocated, never dropped.
  • Poison and drug information center phone number: required on the information panel. The wording around it is yours.
  • Labeled surface under 2 square inches: the short-form warning replaces the full block on the face.
  • Seed and immature-plant packages: short-form warning, in bold.
Before you print
  • Get the current poison center number from the division before platemaking. Do not take it from a third-party summary.
Notes on this section — 1
  • Royal Supply guardrail, not a rule: the consumer warnings in the advertising and marketing section at 16.8.3.8, Please Consume Responsibly among them, are advertising requirements. They get lifted onto packaging by mistake. Keep them off label plates.

Serving SizeAdult-use and medical edibles carry different dose caps, and multi-serving formats have build requirements of their own.
  • Adult-use edibles: 10 mg Total THC per serving, 100 mg Total THC per container.
  • Medical edibles for qualified patients, caregivers and reciprocal participants: 50 mg Total THC per serving.
  • Medical edibles must be identified for medical use only.
  • Edible potency prints on the PDP in bold: Total THC and CBD in milligrams per serving.
  • Also on the PDP: percent Total THC per container, and percent CBD per container if detected.
  • Multi-serving solid edibles must separate into servings with minimal effort.
  • Multi-serving solid edibles must be easily and permanently scored at each serving, and packaged in single-serving units.
  • Multi-serving solid edibles carry the division logo, 0.5 by 0.5 inch minimum, on every serving.
  • Liquid edibles are single-serving only, unless one cap mechanism gives both child resistance and accurate measurement of the poured serving.
Notes on this section — 1
  • The old line requiring the number of servings on the label was dropped. No rule supports it. Per-serving potency and net quantity are what the rule actually requires.

Opaque PackagingNew Mexico does not require an opaque product container. Its only opacity rule lands on the dispensary's exit bag.
  • No opacity requirement applies to the product container.
  • Opaque, transparent and clear container appear nowhere in the packaging section.
  • Clear glass concentrate jars, clear pre-roll tubes and window bags are all compliant, and usually cheaper.
  • Container may not be designed to appeal to children.
  • Container may not mimic a product safe for child consumption.
  • Retail exit package must be opaque. That is the dispensary's obligation, not the container's.
  • Royal Supply recommendation, not a requirement: opaque containers for light protection, discretion at handover, and one tooling set that also clears states that do mandate container opacity.
Notes on this section — 1
  • Watch item before a tooling spend: CCD noticed proposed amendments, hearing dated September 3, 2025, that would require an opaque, resealable, continually child-resistant container and delete the exit-packaging section. Checked again this cycle against the official codification — the part still carries its 04/01/2022 filing and the exit-packaging section is still there, so the amendments have not been adopted and nothing above reflects them. Re-check before committing to clear tooling for a long run.
Absence of any opacity term in 16.8.3.12 NMAC; 16.8.3.13 NMAC (exit packaging); 16.8.3.12.A(1) and A(2) NMAC (child appeal)
ResealableResealable is its own requirement in New Mexico, separate from child resistance, and it reaches products a serving-count test would miss.
  • Flower-only products: resealable container, whatever the serving count.
  • Multi-serving or multi-use products: resealable and child-resistant.
  • That closure must stay child-resistant through repeated openings and closings.
Notes on this section — 2
  • Resolved this cycle: for a flower-only product the resealable requirement REPLACES child resistance rather than sitting on top of it. The rule exempts those products from the child-resistant container requirement in terms.
  • The continually-child-resistant wording applies to the multi-serving and multi-use case. A single-use, non-flower container has to be child-resistant but need not reseal.
16.8.3.12.A(3) and A(4) NMAC
Notable RulesContainer material, design bans, the child-resistance certificate your supplier owes you, and the retailer's exit package.
  • Containers shall be compostable and recyclable, or made from recycled materials.
  • Read the conjunction when specifying: compostable but not recyclable does not satisfy the first option on its own.
  • No cartoons, and no symbols or images resembling cartoon characters.
  • Container may not be designed to appeal to children, or mimic a product safe for child consumption.
  • Label may not carry untruthful or misleading statements, including health or benefit claims.
  • Label may not carry advertising or marketing.
  • No words associated with or marketed to minors, candy and candies included, unless the word names the cannabis strain.
  • The manufacturer must keep a certificate showing that each child-resistant container holding an edible or topical finished product passes 16 C.F.R. 1700.15 and 1700.20 child-resistant effectiveness testing.
  • That certificate duty is written for edible and topical containers. It does not reach a flower jar, which needs no child-resistant closure in the first place.
  • Ask your packaging supplier for that certificate at the time of order, not after an inspection.
  • At retail: product may not leave a licensed retailer's premises unless placed in an opaque exit package.
Notes on this section — 2
  • Watch item, not current law: CCD noticed proposed amendments, hearing dated September 3, 2025, adding the retail licensee license number, the testing laboratory name and license number and the finished-product test date to the label, requiring an opaque, resealable, continually child-resistant container, and deleting the exit-packaging section. Confirmed unadopted this cycle — the codified part still shows only the 04/01/2022 filing. None of it is published above as a requirement. Re-check before the next label cycle.
  • Also watched and also not law: a 2026 bill would have banned packaging shaped like candy, snack food or soft-drink packaging and required opaque packaging for edibles. Action on it was postponed indefinitely in February 2026, so it changes nothing here.
