Product label — ARM 42.39.314(3)1
Substance is mandated, wording is not. ARM 42.39.314(3)(f) requires the label to state that the product was tested and meets Montana requirements, but fixes no sentence. This is Royal Supply's compliant phrasing — reword freely; do not treat it as copy-verbatim.

Statutory warnings — 16-12-215(1), MCA (product package and exit packaging)4
This wording replaced the pre-July-2026 version ending 'cannabinoid hyperemesis'. Department guidance states there is no sell-through: packages labeled before July 1, 2026 may not be sold after that date. The Department of Revenue's own Labeling and Packaging page was still displaying the superseded three-warning set, ending 'cannabinoid hyperemesis', when re-checked on September 1, 2026 — take the four strings from the codified statute at mca.legmt.gov and not from that page. Also required on all forms of exit packaging.
Every package of marijuana or a marijuana product; each of the four must also be printed on all forms of marijuana exit packaging and placed next to the universal warning symbol.

Conditional — ingestion2

Royal Supply recommended

Not required by Montana Department of Revenue, Cannabis Control Division. This is Royal Supply's own compliance-tested language, offered as good practice.

Do not consume additional product while waiting to feel the effects.
Conditional — cardholder-only (high-THC) products2
Never place this on adult-use artwork — it marks the product as cardholder-only.

Packaging & Labeling Rules

Child-ResistantCannabis must reach the customer child-resistant, and the duty covers the dispensary exit package as well as the product container.
  • Child resistant means significantly difficult for children under five to open.
  • Test standard: 16 CFR 1700.20 (2012).
  • Testing documentation from a federally qualified third-party firm is required, filed with the packaging application.
  • The exit package handed over at point of sale must itself be child resistant and resealable.
  • Exit package designs require department approval.
  • Fee: $10 per exit package application type.
Notes on this section — 1
  • Per the Department's May 2026 newsletter, licensees need not resubmit exit packaging for the July 2026 warning changes; compliance is verified at inspection.
ARM 42.39.319(2)(a); ARM 42.39.102; ARM 42.39.320; 16-12-208(6)(a), MCA; 16 CFR 1700.20 (2012)
LabelingLabels must be legible, unobstructed and conspicuous, and most products carry a Marijuana Facts Panel.
  • Type: lowercase letter o at least one-sixteenth inch high.
  • Font: a legible face such as Times New Roman, Arial, or Helvetica.
  • Copy color must contrast conspicuously with its background.
  • Multiple labels, booklets, or accordion formats are allowed where copy will not fit one panel.
  • Marijuana Facts Panel required on flower and on infused products.
  • Seed and plant packages carry no facts panel — only seller and cultivator names, net weight or quantity, strain name, and the universal symbol.
  • Exit packaging carries a QR code to a resource for overcoming marijuana addiction. A generic consumer-education page does not satisfy it.
Notes on this section — 1
  • Do not build artwork specs from the Cannabis Control Division's Labeling and Packaging web page as a substitute for the rules — its flower line omits plain THC, which ARM 42.39.315(3) requires.
ARM 42.39.314(2)(a)-(c), (3); ARM 42.39.315; ARM 42.39.322(1)(d); 16-12-215(5), MCA
THC SymbolThe department's own universal symbol goes on every product, and which cannabinoid numbers you may print depends on the product type.
  • Minimum symbol size: .33 inches wide by .33 inches high. No maximum.
  • Use the department's downloaded artwork. A restyled leaf, triangle, or house redraw does not satisfy the rule.
  • A sticker is acceptable if it holds the .33 in floor, sits unobstructed and conspicuous, and contrasts with its background.
  • Never color the symbol by hand, highlighter, or marker.
  • Required on all marijuana and marijuana products, seed and plant packages included.
  • No panel, corner, quadrant, or label-area percentage is assigned. The four statutory warnings must sit next to the symbol, so symbol and warning block travel together on product package and exit package.
  • Flower, pre-rolls (not infused), and heat-required concentrates: percentages of total potential psychoactive THC, THC, THCa, CBD and CBDa.
  • Ingestible infused products: mg of THC, THCa, CBD and CBDa per serving or dose, servings per package, and total mg per package on multi-serving packs.
  • Non-ingestible infused products: the same mg set per application or dose, doses per package, and package total on multi-dose packs.
  • Concentrates not requiring heat: either those four percentages, or mg per serving plus servings per package.
  • Products not requiring heat may not print a total THC or total potential psychoactive THC value on the facts panel.
  • Ingestible and non-ingestible infused panels may not carry those totals or otherwise overstate THC.
  • Seed and plant packages: no facts panel, no cannabinoid values at all.
Before you print
  • Confirm the downloaded symbol file matches the artwork depicted at ARM 42.39.314(3)(h)(iv) as currently codified.
Notes on this section — 3
  • rules.mt.gov again returned HTTP 405 on every route tried, including the site root, when re-checked on September 1, 2026. The ARM text here rests on two agreeing law publishers and is established only through June 2025.
  • No ARM amendment conforming 42.39.314 to the four-warning scheme has surfaced. The Legislature's Cannabis Control Division rule-review tracker lists nothing after May 2024, and the Department's only 2026 adoption notice — MAR 2025-372.2, effective March 21, 2026 — amends the testing rules at 42.39.601, .610 and .614, not the labeling rules.
  • The four warning strings, the typography rule and the poster requirement are all carried by 16-12-215, MCA, which is verifiable at mca.legmt.gov. Nothing a customer prints depends on the unverifiable ARM text alone.
ARM 42.39.314(2)(a)-(c), (3) chapeau, (3)(h)(i)-(iv), (9); ARM 42.39.315(1),(3)-(4); ARM 42.39.316(1)-(2); ARM 42.39.317(1)-(2); ARM 42.39.318; ARM 42.39.319; ARM 42.39.322(1)(d); 16-12-215(1)-(2), MCA
Health WarningsWarning copy is split between the product label and the exit package, and the two sets are not interchangeable.
  • Product label: keep out of reach of children and pets; may be addictive; intoxicating effects and do not drive.
  • Product label also carries the testing statement.
  • Every package: all four statutory WARNING statements, placed next to the universal symbol.
  • The four are cumulative, not rotating — all four appear together.
  • Exit packaging: the same four warnings on every form of exit packaging.
  • Warning type: legible font such as Times New Roman, Arial or Helvetica, with the lowercase o at least one-sixteenth inch high. This is set by the statute itself, not only by rule.
  • Ingestibles and activated concentrates meant for ingestion add the delayed-effects warning.
  • Cardholder-only high-THC products add the medical-use and FDA statements.
Before you print
  • ARM 42.39.314(2)(c) independently requires conspicuous contrast. Confirm with the Cannabis Control Division before treating black-on-white as a print requirement.
Notes on this section — 3
  • The typography rule now sits in 16-12-215(1), MCA as amended by HB 792, in almost the same words as ARM 42.39.314(2). That matters this cycle: the ARM text cannot be verified at source, and the statutory copy can.
  • Black ink on a white background for exit-packaging warnings comes from the Department's May 2026 newsletter — agency guidance, not codified rule. Neither 16-12-215, MCA nor ARM 42.39.314 specifies ink or background color.
  • Trade-press sources attributing an ink rule to HB 792 are wrong.
16-12-215(1)-(5), MCA (eff. July 1, 2026); ARM 42.39.314(2)(b), (3)(f), (4), (8); ARM 42.39.319(2)(c); 16-12-208, MCA
Serving SizeIngestible potency is capped per serving and per package.
  • 5 mg delta-9-THC per serving maximum, with a 10 percent deviation allowance.
  • 100 mg delta-9-THC per package maximum for ingestible products.
  • Multi-serving packs must print servings per package and the package total.
Notes on this section — 1
  • The 5 mg cap took effect July 1, 2026 under HB 636. Artwork built to the old 10 mg cap is out of date and may not be sold.
16-12-224, MCA (as amended by HB 636, eff. July 1, 2026); ARM 42.39.316
Opaque PackagingOpacity is an exit-packaging rule in Montana, not a product-container rule.
  • Exit packaging provided at point of sale must be opaque.
  • No opacity rule applies to the primary container — a clear jar or a window is fine.
Notes on this section — 1
  • No Montana rule requiring tamper-evident sealing was found. Royal Supply recommends it as sound practice; do not present it as a state mandate.
ARM 42.39.319(2)(b); ARM 42.39.102
ResealableA package holding more than one serving must be resealable, and the rule names no mechanism.
  • More than one serving: the package must reseal after opening.
  • Any working closure qualifies — a fold-over flap with an adhesive strip is enough.
  • No zipper requirement in Montana.
  • The exit package must be resealable and child resistant.
  • Drinkable products with more than one serving per package must include a device or mechanism for measuring a single serving. Budget for the cup, cap or dosing device as part of the pack.
Notes on this section — 1
  • Royal Supply recommends a zipper or press-to-close for durability over repeated openings. Our recommendation, not a state requirement.
ARM 42.39.319(1)(b); 16-12-208(6)(a), MCA
Notable RulesTwo separate 2025 bills reshaped Montana packaging on July 1, 2026, and there is no sell-through window.
  • No sell-through: packages created or labeled before July 1, 2026 may not be sold after that date.
  • HB 792: four warning statements instead of three, placed next to the universal symbol.
  • HB 792: the same four warnings on all forms of exit packaging.
  • HB 792: an addiction-resource quick reference code on each exit package.
  • HB 792: a point-of-sale consumer education poster at least 8 1/2 by 11 inches, carrying the symbol, all four warnings, addiction-resource contacts and the code.
  • HB 636 is a different bill: it cut the ingestible per-serving cap from 10 mg to 5 mg. Do not attribute the potency change to HB 792.
  • No child appeal: no depiction of a child, no cartoon figures or celebrities, no imagery with special attractiveness to children.
  • No reasonable resemblance to the trademarked or characteristic packaging of commercial candy, snacks, baked goods, or beverages.
  • Exit package designs require department approval.
  • Exit packaging may carry nothing beyond what 16-12-208(6)(b)(ii), MCA allows — no extra information and no extra design elements. Treat the exit bag as a fixed layout, not a branding surface.
  • Current exit-bag warning labels, the QR code artwork and the consumer education poster: revenue.mt.gov/card/cannabis/labeling-materials.
Notes on this section — 5
  • Licensees are not required to resubmit exit packaging for the 2026 changes; compliance is verified at inspection.
  • The Cannabis Business Marketing and Advertising Guide is now the licensee compliance reference; the Department no longer reviews or approves advertising scripts.
  • The Department's general Labeling and Packaging page and its downloadable label templates still showed the superseded three-warning set on September 1, 2026. Do not build artwork from those templates without replacing the warning block. The separate HB 792 Implementation: Labeling Materials page is the current one, and it carries the four-warning exit-bag labels, the QR code and the poster.
  • The conforming rule amendment now exists. MAR Notice No. 2026-93.2, adopted by the Department of Revenue and effective August 22, 2026, amends ARM 42.39.122, 42.39.314 and 42.39.319 to implement HB 792. 42.39.314 was amended as proposed; 42.39.122 and 42.39.319 were amended with changes, and the change was to the URL licensees download the QR code and poster from.
  • The four statutory warning strings on this page were compared this cycle against the Department's own printed exit-bag label artwork and match word for word.
16-12-215, MCA and 16-12-224, MCA (History notes); HB 792 (Sec. 2, Ch. 532, L. 2025); HB 636; ARM 42.39.122, 42.39.314 and 42.39.319 as amended by MAR Notice No. 2026-93.2, eff. 8-22-26; ARM 42.39.320
